DEFINITIONS:
- “Card Issuer”: The bank that provides debit and credit cards or prepaid cards to the customer or the cardholder.
- “Bank” or “ABK”: Means Al Ahli Bank of Kuwait (KSCP)
- “Customer or Applicant”: The natural person or body corporate applying for the card.
- “Cardholder”: The person to whom the card was issued and whose name appears on it.
- “Cardholder’s Data”: Any personal information identifying a person to whom a debit card, credit card or prepaid card was issued. The cardholder information includes the basic account number (PAN) as well as several information including: cardholder’s name, expiration date and service code.
- “Tokenization technology”: It is the replacement of card data with unique, secure codes.
- “Transaction or Card Transaction”: Means the transaction of the purchase of goods, access to services, cash withdrawals, etc., by the use of the Card by any means.
- “Token”: The code of encrypted data.
- “Device”: A smartphone, tablet, smartwatch or other device that suits the wallet and which the bank determines the use thereof for any of its cards transactions.
- “Wallet”: Means method of payment by smartphone or smart device and digital wallet services provided by the service provider allowing the user / cardholder to make an electronic payment by using specific cards registered on these devices.
- “PIN Code”: Means the Personal Identification Number (PIN code) necessary to access a device and includes a password, passcode, pattern or biometric identifier (where applicable).
- “Token service provider”: The provider that accomplishes many tasks, especially the creation and storage of Tokens and linking between the primary account number and the token and validating the use of the token.
- “Token Applicant”: Many parties can request the token from the service provider such as merchants, electronic payment gateways or parties with a relationship with the user or any other parties wishing to deal with this service.
TERMS AND CONDITIONS:
- The service is provided free of charge.
- The creation of the wallet is free of charge.
- Activation of the service is only at the request of the customer and through his phone.
- The validity of the service is linked to the validity of the card.
- The Customer and / or the Cardholder shall be solely responsible for the Card, the security of the Smart Device and its use, the use of the personal or PIN number or any identifying information related to the use of the Token Service, and shall bear all the consequences thereof, especially if such information is lost or used by third parties. The Customer shall compensate ABK for any damages or losses arising as a result of this, and the Cardholder / Customer shall be fully responsible for all fees, costs, losses and damages arising from the breach of any type whatsoever, and for whatever reason.
- The Cardholder / Client shall notify ABK immediately in case of violation of the PIN or disclosure thereof to another person or entity.
- The digital wallet provides another way for the cardholder or the customer to make purchases or electronic payments through the card, so the terms and conditions of the card shall apply to all transactions done through it, including fees, charges and interests due as agreed in the card contract.
- The customer / cardholder shall pay any other fees that the service provider or any third party may charge on the token service provided.
- The cardholder or customer can add ABK cards to the wallet by following the instructions of the wallet service provider.
- Only ABK determines the wallet eligible cards.
- Only the Bank has the right to determine which cards are eligible for listing and whether to use the digital wallet according to the credit status of the customer or cardholder.
- The customer / cardholder is allowed to carry out transactions on the digital wallet after the accepted card is added to the wallet and the bank reserves the right to determine which cards are eligible for inclusion in the digital wallet. The wallet may be accepted in some places, but not all, without any liability on the card issuer bank.
- ABK reserves the right to refuse or allow / process any transactions in case of suspected breach of terms of use or for security purposes or fraudulent or illegal activity. The Cardholder or Customer shall not be entitled to claim any financial losses due to this act from the “bank”.
- When the “Cardholder” or “Customer” adds ABK card to the wallet, the Bank collects certain information to verify the identity thereof, in order to enable it to use the card and facilitate its sharing in the wallet.
- ABK will also request specific account information for each card that the Cardholder or Customer selects to use with the Wallet, including the most recent transaction information on the Card to ensure that the Cardholder is performing the transaction and the Bank will not request the full Card number from the client.
- The Cardholder or Customer agrees that ABK may also periodically collect and use technical data and related information, including but not limited to the technical information about the Cardholder or Customer to facilitate updates ABK services. ABK may use this information to improve its products or provide services or technologies to the Cardholder or the Customer as long as they do not personally identify you.
- The Cardholder or the Customer may receive payment alert messages from the Wallet reflecting the Card Account activities. If you do not wish to receive payment messages, you can turn them off in your device settings or Wallet application settings.
- ABK transactions made through the wallet within Kuwait’s borders are subject to the rules and regulations of the State of Kuwait.
- Transactions outside Kuwait will follow the rules and regulations of the countries where the transaction took place.
- If the “Cardholder” or “Customer” has any questions, disputes or complaints about the Wallet, please contact ABK on 1899899, available 24 hours a day.
- ABK is not an electronic wallet service provider and is not responsible for providing the wallet service to the cardholder or the customer.
- The Bank shall not be liable if the transaction fails from the Wallet in any transaction carried out by the Customer or the Cardholder
- The Bank shall not be liable for the performance of the Digital Wallet Service Provider or any agreement with other third parties entered into by the Cardholder or Customer with the Wallet Provider or any relationships with a third party that may affect the use of the Wallet.
- The Bank shall not be responsible for the use, effectiveness or provision of the Wallet Application or any Wallet Device and is not responsible for the provision of Wallet-compatible reader devices at commercial locations or the low level of service resulting from the failure of third party communications and networks.
- The Bank shall provide information securely to the Wallet Provider to allow the use of the Card (s) in the Wallet.
- All transactions resulting from this service and card operations are subject to the provisions of Kuwaiti law and the jurisdiction of the Kuwaiti courts to settle any disputes arising out of or in connection with Digital Wallet or Token operations.
- The Card shall remain at all times the property of ABK and it shall be the responsibility of the Cardholder or the Customer to return it whenever the Bank so requests.
- If this Agreement is terminated by the “Cardholder” or the “Customer” and the “Cardholder” or “Customer” returns his cards issued by ABK to the Bank, all obligations and rights due to the Bank relating to this agreement shall not be affected prior to termination.
- All other ABK’s Terms and Conditions shall be confidential. ABK may amend or change the Terms and Conditions of this Agreement at any time.
- ABK reserves the right to amend any of these terms and conditions at any time, and any amendment announced by ABK or any of its branches or by any other means deemed appropriate, is a valid and effective amendment from its date and shall be binding on the Cardholder or “Client”.
